Customers buy goods and services that you sell under your trademark, retailers sell and market your trademarks, and it is under your trademarks that your goods or services become known.
What if my trademarks are not protected?
It is possible that someone else could register trademarks that may be identical or similar to your trademarks. This would put an end to your usage of them. If you can no longer use your trademarks, then your customers do not know which goods and services are being provided by you. They may then choose to buy the same or similar goods or services under different trademarks that are not provided by yourself. If you do not protect your trademarks, this may force you to start again from scratch.
How can I protect myself?
You can protect your trademarks in two ways. Either you are protected through applying for registration or you are protected through the actual use of a trademark, so-called incorporation. Applying for registration of your trademark is the quickest and most cost-effective way. It is expensive and takes time to prove that your trademark has been incorporated, since you have to demonstrate that it has been used to such an extent that it has become widely known in the marketplace. Therefore, the cheapest and simplest way to protect your trademark is to apply for trademark registration.
